Presidential Candidate Alan Keyes’ lawsuit filed in The Republic of California seeking Obama’s eligibility as a natural born citizen, has been dismissed and so was a lawsuit brought by two Indiana men seeking to invalidate Indiana’s election results based on President Barack Obama’s citizenship status.

The Judge in the case Hollister v Soetero delivered a scathing ruling in which he gave the lead counsel John D. Hemenway, 11 days to respond as to why he should not be sanctioned.  Native Born Citizen provides this gem, “Example: It suggests that the intellectual capacity of this Court focused on the issues in the instant suit at a very low level, perhaps for political purposes, such as to win attention from the highest authority when a seat on the Supreme Court of the United States becomes vacant.”  http://nativeborncitizen.wordpress.com/

Intellectual capacity?  Attention from the highest court?  Is there not one court or judge in all the land that has enough intellectual capacity to provide the legal means of requiring Obama to provide in a court of law, his authentic birth certificate?  Is there not one attorney who can find a way to prove they have standing in the courts?  What a disgrace by all accounts, but mostly by our President Obama.  Obama has never been legally required to provide a birth certificate to the courts, but he should have the highest moral obligation to provide it to the American people. 

On St. Patrick’s day I suppose everyone is a wee bit Irish.  Hat’s off to ya President Obama, but we hope the luck of the Irish brings him in front of the the court to provide his birth certificate, and soon.

Last week, President George W. In part, “pray this Court will determine that the inauguration set for January 20, 2009 should be stayed pending the outcome of this, and similar litigation, determining that the Plaintiff has a substantial likelihood of success on the merits, that under Article II, Section 1 and Amendment 20 Section 3 of the U.S. Constitution, Defendant Barack H. Obama is not a natural born citizen and has not qualified,…”  I wouldn’t expect a ruling today. Chief Justice Roberts will be busy swearing in Obama.

If the courts of the law haven’t seen fit to allow one, just one, freaking case to proceed to require Obama to show his legal birth records, then either the attorneys have failed in their job or justice has failed.

According to the Wall Street Wire of the Wall Street Journal, “President-elect Barack Obama and Vice President-elect Joe Biden will visit the U.S. Supreme Court today after an invitation was extended by Chief Justice John Roberts. [sic 01142009]

This is the third time in modern history that a president-elect and vice-president elect have made pre-inaugural stops to the court—Bill Clinton and Al Gore visited the court on Dec. 8, 1992 and Ronald Reagan and George H.W. Bush visited the court on Nov. 19, 1980.

Obama and Biden will meet with Roberts and the associate justices in the ceremonial West Conference Room, and are expected to take a tour of the court. Chief Justice Roberts is scheduled to officiate the swearing in of Obama on January 20, 2008 , but lingering court cases regarding Obama’s citizenship have been shuffling around the Supreme Court.  All have been denied or denied without judgment, so far.  Still, cases are pending.  Perhaps this is a perfect opportunity, behind closed doors for the Justices to ask Obama if he is qualified under our Constitutional Law, to hold the office of President.  Maybe they will ask him but even if they do, I doubt we would ever be privileged to the answer.   

Obama said, “I was a constitutional law professor, which means unlike the current president, I actually respect the Constitution”  but then again we have to ask how does Obama propose to protect and defend a document he believes to contain a “fundamental flaw”?

Obama’s eligibility appears to be a go go from The Supreme Court.  Oh no, no, no some will say.  Numerous court cases have challenged President Obama’s natural born citizenship under Article II, Section 1 of the United States Constitution that says that the president be a “natural born citizen.”  All have been met with the same outcome as today- Denied.

Does Obama have divided loyalties?  I doubt it.  Really, the minute Obama would act to place Kenya or Indonesia above the best interests of the USA, the wrath of the domestic and foreign media, Congress, the Senate and even Nancy Pelosi would jump to attention and outrage.  Wouldn’t they?

Whatever the evidence may bear in the future, on January 20, 2009, Barack Hussein Obama is most likely going to place his hand on former President Lincoln’s Bible and swear to the duty of allegiance to the United States of America.   This bond will be administered by Chief Justice  Roberts who will carry out his ceremonial duty of swearing in the next President of the United States.  If Roberts was to consider the possibility that he is swearing in a man who doesn’t  meet fundamental eligibility requirements, I imagine he would be removed unceremoniously and rapidly from the bench.  Or perhaps made a hero to those who seek the legal means to force Obama’s citizenship discloure.  Maybe the failure to deny Anderson will be enough for pause.  Berg, Donofrio and others have certainly made their cases before the justices and while not hearing the cases formally, must be aware of Obama’s current question of ineligibility for the office he is about to be sworn into.

The Supremes have once again spoken in saying nothing,  and by leaving the Anderson Amicus hanging have further blurred the waters.   

Obama, by delivering his official birth records to support his compliance with the Constitution and his professed transparency in government would alleviate future burdens on The Court and her people.  I don’t think we can hold our breath that long.  Instead, we’ll watch a new chapter of American history unfold with a democrat, black man leading our destiny either for the next four or eight years, unless a court forces him to prove his citizenship and it turns out he is ineligible.  I pray for a sufficient bond of union between Obama and America to allow him to make worthwhile choices in keeping America the land of the free and home of the brave.

Make no mistake, Obama as President Elect needs to show his authentic, verifiable birth certificate and to not do so is an utterly and complete disgrace and sabotage of our U.S. Constitution.   America herself should be proud to move past racism in electing a black man.  There should be no praise for a man who can not move past the fact that some of those same people who elected him are now questioning his authority and qualifications under Article II, Section I that defines who may hold the office of President. 

No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty five Years, and been fourteen Years a Resident within the United States.

What an embarrassment for our country to have let the issue of his citizenship and eligibility as President elect to have gotten this far .  The rest of the world must be snickering albeit silently, that the man they will have to deal with on international matters could be so manipulative to have deceived his own people to achieve his own goals of reform and change.  What other methods of deceit may come from an Obama administration?  

Denying his citizenship to the same people who propped him up is a slap in the face that will leave America stinging for years if we find out he is not a qualified U.S. Citizen.

I don’t see how it is showing fondness for Barack Obama to let him enter into office with a question that could be raised. He should not have to operate under that burden. I think the officials need to clear the air for his sake. From my point of view, it is a bad idea to have a president of the United States enter office with a cloud hanging over his head, where every time he tries to do something, he would end up frittering away time because of that objection. So let’s get it over with. Let’s resolve it and move forward with a clear an undisturbed mandate for the new president.”

I’d say it is an inconvenience indeed when your 1st Amendment rights keep getting slammed.  A universal avoidance of the mainstream media on this issue is suspect but shutting the doors to a simple blog is unequivocally, a loss for free speech.  I’d also say it is more than an inconvenience to have a President Elect Obama refuse to produce his birth certificate.

Shame on Obama and shame on the DNC and the RNC for allowing it to get this far.

MOTION FOR RECONSIDERATION OF COURT’S

ORDER OF NOVEMBER 19, 2008

Preliminary Statement

The Court managed to take what is at its core a simple and straightforward case seeking review of denial of access to a Hawai’i record, and to add layers of confusion and complexity that were totally unwarranted by the record made in open court on November 18th. For the reasons that follow, Plaintiff moves the Court to reconsider, vacate and rehear the matters decided on November 19th using the correct procedures and standards of law.

Plaintiff initially thought that he would appeal the order to the Intermediate Court of Appeals, but it would be a disservice to that Court to appeal such a mangled and needlessly confused record from the trial forum. Thus, the Rule 59 motion (see below) stays any appeal until a decision on this motion.

Martin claims he did not get a judgment from the court? What? Hawaii Circuit Court Judge Bert Ayabe has dismissed Internet author Andy Martin’s lawsuit seeking to obtain a copy of President-elect Barack Obama’s Hawaii’i birth certificate.  The judge upheld arguments from Gov. Whatever opinion you have about Andy Martin, one must admire his tenaciousness in seeking out the truth about Obama’s birth certificate and citizenship eligibility for the office of President. 

Of all the low down dirty deeds regarding Obama’s citizenship, I had forgotten all about Senate Resolution 511.  Before Obama’s www.fightthesmears.com even began to address lurking questions on Obama’s illicit associations with Ayers, Retzko, Wright and the citizenship issue with Berg v Obama at the Supreme Court or Donofrio v Wells scheduled for a SCOTUS conference on December 5, 2008, was SR 511. 

What started out as an effort to put to rest any objection to Senator John McCain’s eligibility to become our nation’s President because he was born outside of the U.S. in Panama, was in fact a preemptive strike to eliminate any claim that Obama might not be a natural born citizen either . A February NY Times article raised the question as to whether McCain, who was born in 1936 on a U.S. military installation in the Panama Canal Zone, satisfied the constitutional prerequisites to become president. Article II, Section 1 of the Constitution requires a president to be a natural born citizen.

“There are powerful arguments that Senator McCain or anyone else in this position is constitutionally qualified, but there is certainly no precedent,” Sarah H. SR 511 is Constitutional Resolution that got slam dunked when it passed in April of this year (08). Obama’s congressional supporters – including Gov. Claire McCaskill (D-MOi), Senator Patrick Leahy (D-VT), Sen. Barack Obama (D-IL) Sen. Tom Coburn (R-OK), Sen. Hillary Clinton (D-NY), and Sen. James Webb (D-VA) –proposed and passed a Resolution (S.Res.511) entitled: Recognizing that John Sidney McCain, III, is a natural born citizen.  http://www.opencongress.org/bill/110-sr511/text.

S. Res.511 clearly states that “…Whereas the term `natural born Citizen’, as that term appears in Article II, Section 1, is not defined in the Constitution of the United States…”

Whereas, a natural born Citizen is not defined?  Hold your horses there and re-read.  Natural born citizen is not defined.  Hmmmmmmm? The bill states, ” Whereas previous presidential candidates were born outside of the United States of America and were understood to be eligible to be President…”  This piece of legislation was introduced, written and passed clearly with intent to extend the meaning of the Constitution, and prior to SR 511 there was no presidency in Congress.  

Mrs. Clinton’s support and co-authorship of this bill, even though they were battling in the primary election for the presidency, was so incredibly strategic and manipulative on Obama’s part that it borders on absolute fraud.  The bill completely attempts to redefine his citizenship and will try to keep him eligible, constitutionally as the 44th President, even after he finally shows his Official Vault Birth Certificate. 

Do you honestly think Obama wants Hillary Clinton to act as his Secretary of State?  Obama owes Hillary big time for sponsoring SR 511, and her nomination as SOS is payback.  He will put up with her, and torture her until he can no longer stand it or she will, herself – resign from the position. 

The Supreme Court may seek to grant Donofrio, Berg, and maybe even Keyes, a day in court and America may finally come to know the truth on Obama’s birth certificate.  It has been alleged his birth is in Kenya, he lost his citizenship in Indonesia, his mother was a minor when she gave birth, his dad was Frank Marshall, he is an illegal alien, blah, blah, blah- according to SR 511- the Democrats would have us believe Constitution was tossed by the wayside and no matter.

Whether or not we are ever witness to his birth certificate, the facts are fuzzy and circumspect that Obama may not be qualified to hold any office in the United States.  Would any elector who now votes for Obama may be found guilty of treason?  

The Electoral College meets on December 15, 2008 to issue an official election determination. Three is little doubt intelligence has been keeping a watchful eye court proceedings.  Would there be peaceful noncompliance, civil disobedience, Martial Law? 

This is not the change anyone had hoped for from Obama.

http://www.freerepublic.com/focus/f-bloggers/2136816/posts has quotes like this and a HUGE, AWESOME BLOG POST of inaccuracies in what has been presented via Factcheck, the DailyKos, Politico and others as an authentic certificate of life birth from Barack Obama.  Free Republic makes a pretty good case that what has been shown to the American People by Obama, is in fact a forgery and fake document.  Ahrcanum knows of no lawsuit including Berg v Obama et al, or Donofrio v Wells that has of yet, required Obama to produce his legally, verifiable birth certificate. YET, being the key word.

By now one would think the MSM- Main Stream Media would be hooting and hollering that our Constitution could be in crisis, but nary a word.  Coverage on the net is sparse and unless one is specifically looking for the topic hard to come by.  Many comments on sites that do cover his citizenship issue resemble this, ”There is no reason to believe that Obama is not a natural born American citizen other than some people really, really, really want it to be otherwise. The latest known filing is from Presidential Candidate Alan Keyes.  He spoke regarding apartheid, but the quote still has merit today ,”“I think it is racist to suggest that my mind should somehow be bound by black instead of reason,” Keyes later explained in a January 1996 interview with a reporter for The Philadelphia Inquirer. “I will follow reason, and reason has no color. Whatever: Mr. Keyes http://www.usjf.net/ , Mr. Berg http://www.obamacrimes.com/ , Mr. Donofrio http://thenaturalborncitizen.blogspot.com/, Mr. Martin’s http://www.contrariancommentary.com/community/ and many other citizen filings motives are in filing these lawsuits, the outcome serves in the best interest of all Americans to see that the person who holds the office of President, is in fact, eligible under our citizenship laws. Mr. Obama has been ducking like Muhammad Ali, and the last punch may come from the Supreme Court and Justice Thomas.  Obfuscation is a dance better left to boxing professionals, not politicians who profess change by deceit or the Main Stream Media, who ignore news.

Hawaii Circuit Court Judge Bert Ayabe has dismissed Internet author Andy Martin’s lawsuit seeking to obtain a copy of President-elect Barack Obama’s Hawai’i birth certificate.  The judge upheld arguments from Gov. Linda Lingle’s administration that Martin — a political opponent of Obama — had no standing under state law to obtain a copy of the document.

Martin “does not have a direct and tangible interest in the vital statistic records being sought, namely the birth certificate of President Obama,” Ayabe wrote.

To date the evidence as provided by Obama seems compelling.  That— the President-Elect was born in the Kapi’olani Medical Center for Women and Children, in Honolulu, Hawaii, on Aug. 4, 1961- Hawaii was a state at that time. Sen. Obama’s mother, Ann Dunham, who died in 1995, was an American by birth. She was from Wichita, Kansas. His [sic- alleged] dad, Barack Obama, Sr., was from Kenya. His parents divorced in 1964. In 1967, Obama moved to Indonesia with his stepfather, Lolo Soetoro and his mother. In 1971, he returned to Hawaii, to live with his grandparents, Madelyn and Stanley Dunham, who raised him.
